The Process at CMCS

Complete Close

Upon receiving the title order and/or sales agreement, we begin the process to close on your home. A Complete Close is a commitment to ensure the property is searched, all tax certificates are obtained, signing the final closing documents, and issuing the final title policy.

Title search on the property

CMCS will perform a title search on the property to determine any mortgages, liens, judgments, or clouds are on the title. If so, we will work to obtain the payoffs to issue a clear title commitment for these to be paid at closing.

Obtain property tax certifications

As required by each municipality, CMCS will obtain property tax certifications, lien letters, and final water/sewage letters, as required to insure there is nothing owed on the property or will need paid at closing.

Complete Unique Municipality requirements

Each Municipality has a unique set of requirements. These requirements include, but are not limited to, dye tests, lateral inspections, zoning certificates, and occupancy inspections.  Most of these requirements require the involvement of the seller and/or representative to complete and schedule directly with the municipality.  In some circumstances, you must obtain a certified/registered plumber to perform the dye test and/or lateral inspections.  Certain tax collection agencies, municipalities and boroughs have a specific turn-around time to complete these requests.  This can take a minimum of 7-10 business days or longer. Once all the Municipality requirements are completed the tax certifications and/or lien letters may be released to CMCS for completion.

Closings

At CMCS we work directly with your real estate agents, mortgage loan officers, lenders, and attorneys to close in an efficient manner, as time is of the essence. We realize the importance of deadlines, rate locks, cross country moves and strive to accommodate all timelines.

Closing Disclosure (CD) and/or HUD

Once everything is approved, received and ready to close, we will work with the lender/bank, if applicable, to complete the final Closing Disclosure (CD) and/or HUD. The Closing Disclosure (CD)/HUD will give you figures to what your costs will be at closing.

Title Insurance

Why Buy Title Insurance?

Title Insurance protects the policy holder in the event of a threat to their interest in real property. Title insurance is your first line of defense against unforeseen defects or issues pertaining to the title of your home.  If your property is found to have illegal deeds, forged documents or unknown liens YOU could be liable. The reasons you could have a clouded title are numerous and the costs can add up quickly. Without the protection of title insurance you will be responsible for these costs. Throughout the years you will make many investments and even more memories in your home. Make a Title Insurance Policy the first investment you make to protect those cherished memories.

When purchasing a policy Complete Mortgage Closing Solutions will do an in depth background check of the property’s owner history. This search will show if the home has “clear title”. A “clear title” means the seller of the home is the complete owner without any other legal claims against the property. When you take out a mortgage on your property the lender requires a “Lender’s Policy” to protect the lender’s investment in your home.  The “Lender’s Policy” will only provide coverage for the life of the loan. So, if you decide to refinance your property the first loan ends and a new one begins. Therefore a new “Lender’s Policy” must be issued.  As the buyer you have the opportunity to purchase an “Owner’s Policy” which will provide you the protection you need and the peace of mind you deserve.

What is Title Insurance?

Title insurance is exactly that. Insurance that will protect you in the case of a previously undiscovered defect in the title of your home comes to light. When it comes time to close on the purchase of you home you will see two types of title insurance offered. The first is the Lender’s Policy. When you receive a loan for the purchase of your home the lender will require a Lender’s policy to decrease their financial risk in the property. The other option is the Owner’s Policy. Unlike the Lender’s Policy which only protects the lender, the Owners Policy is your opportunity to provide yourself protection. With most other types of insurance you pay a monthly premium but Title Insurance is paid at closing. With Title Insurance you get the extra protection without the extra burden of monthly payments.

Here at Complete Mortgage Closing Solutions we take the process of issuing Title Insurance Policies very seriously. Upon receiving the title order we begin thoroughly examining the history of the home. Not only will we uncover liens, unpaid taxes, judgements, and mortgages on the property but we also communicate directly with local areas to determine the specific requirements they have. These requirements include but are not limited to zoning certificates, dye tests, occupancy inspections and other building restrictions. The title research process is an important part of the due diligence you should perform to learn as much about the home you are buying as possible.

What are some of the potential dangers?

  • Forgery
    • With the advancement of technology comes the advancement of fraud. It is very easy today to forge documents, digitally alter signatures or even assume another person’s identity. It is possible for these forged documents to be filed in the public record putting your rights in the home at jeopardy.
  • Liens
    • The Previous owners of the home may not have paid their bills. A lien can be placed on the property by the local authorities, contractors for work done on the property, or even the federal government.
  • Missing Heirs
    • In the event of the death of the property owner the property will transfer to their immediate heirs or follow the guidelines of their will. In some cases the heirs will be missing or unknown. Other family members can contest the will wanting their own rights in the property. Either of these situations can cause major problems even after you’ve purchased the property.
  • Undiscovered will
    • It is possible that a will is found after the property has been sold to another party. If you are that other party your ownership can be threatened.
  • Public Record Errors
    • An error in the filing of the deed or the property survey could signal problems for you the homeowner. A simple mistype of a word or number could mean headaches for you.
